1. Agreement to Terms

By accessing or using the Socrates Educational Platform ("Socrates," "the Platform") at socrates.ofbwfh.net, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

If you are a student under 18, your parent or guardian must review and agree to these Terms on your behalf. By creating a student account within their family, your guardian has agreed to these Terms for you.

These Terms constitute a legally binding agreement between you and the Socrates Educational Platform ("we," "us," or "our").


2. Eligibility

2.1 Age Requirements

  • You must be at least 12 years old to use the Platform.
  • If you are under 13, your parent or guardian must provide verifiable parental consent before your account can be activated, as required by the Children's Online Privacy Protection Act (COPPA).
  • If you are 13 to 17, your parent or guardian must create a family and invite you. By doing so, they consent to these Terms on your behalf.

2.2 Guardian Accounts

  • Guardians must be at least 18 years old.
  • Guardians represent that they are the parent, legal guardian, or authorized caregiver of any student they add to their family.

2.3 Accuracy of Information

  • You agree to provide accurate, current, and complete information when creating your account.
  • You agree to update your information if it changes.
  • We reserve the right to suspend or terminate accounts with materially inaccurate information.

3. Account Responsibilities

3.1 Account Security

  • Accounts are accessed via magic-link email authentication. You are responsible for maintaining the security of the email account associated with your Socrates account.
  • You must not share your login links with anyone.
  • You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

3.2 One Person Per Account

  • Each account is for a single individual. Guardians may manage multiple student accounts within their family, but each student must have their own account.

3.3 Guardian Oversight

  • Guardians are responsible for overseeing their students' use of the Platform.
  • Guardians can view student activity, progress, AI interactions, and messages.
  • Guardians are responsible for ensuring their students comply with the Acceptable Use Policy.

4. Description of Service

Socrates provides the following educational services:

  • Homework Analysis: Students upload homework or assignments. AI analyzes the content to identify subjects, concepts, and learning objectives.
  • Interactive Game Generation: AI generates structured educational games based on the analyzed homework.
  • Socratic Tutoring: An AI-powered help system that guides students through concepts using the Socratic method — asking guiding questions before providing direct answers.
  • Study Audio: AI-generated audio study materials based on uploaded content.
  • Progress Tracking: Performance metrics, learning streaks, and mastery indicators.
  • Rewards System: A virtual currency system (Socrates Coins / drachmas) for motivation and engagement.
  • Family Communication: Messaging within family groups.
  • Content Proxy: Curated educational resources from trusted third-party sites, served through a server-side proxy.

5. Acceptable Use

Your use of the Platform is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Key points:

  • Upload only your own homework, assignments, and study materials.
  • Do not upload inappropriate, offensive, or illegal content.
  • Communicate respectfully in family messages.
  • Do not attempt to circumvent security measures or access accounts belonging to others.

Violation of the Acceptable Use Policy may result in warnings, suspension, or termination of your account.


6. Intellectual Property

6.1 Student-Owned Content

  • You own your homework. Any homework, assignments, study materials, notes, or other content you upload remains your intellectual property. By uploading content, you grant us a limited, non-exclusive license to process it through AI providers for the purpose of generating educational materials for you.
  • You own your game performance data. Your scores, progress data, and learning metrics belong to you. You may request an export at any time.

6.2 Platform-Owned Content

  • AI-generated game content (questions, game structures, study audio) is owned by Socrates Educational Platform. This content is generated for your personal educational use and may not be redistributed.
  • Platform design, code, characters, and artwork (including Socrates, Daphne, Nikos, Athena, Hermes, and the Owl characters) are owned by Socrates Educational Platform and protected by applicable intellectual property laws.
  • User interface elements including the Ancient Greek theme, animations, and layouts are proprietary.

6.3 Feedback

If you provide suggestions, ideas, or feedback about the Platform, you grant us the right to use that feedback without restriction or compensation.


7. AI Usage Disclosure

The Platform uses artificial intelligence extensively. By using the Platform, you acknowledge and agree that:

  1. Your uploaded content is processed by third-party AI providers (Anthropic and OpenAI). See our AI Transparency Statement and Privacy Policy for details.

  2. AI-generated content may contain errors. While we validate AI outputs using structured schemas and content filtering, AI is not infallible. Game questions may occasionally contain inaccuracies. The tutoring system provides guidance, not certified instruction.

  3. AI does not replace teachers, tutors, or educational professionals. The Platform is a supplementary learning tool. It does not assign grades, make educational placement decisions, or provide certified instruction.

  4. AI does not make decisions about your account. Account actions (warnings, suspensions, terminations) are taken by human administrators, not AI.

8. Virtual Currency (Socrates Coins / Drachmas)

8.1 Nature of Virtual Currency

Socrates Coins ("drachmas") are a virtual reward system used within the Platform. They are:

  • Not real currency. Drachmas have no monetary value outside the Platform.
  • Non-transferable. Drachmas cannot be transferred between accounts or to any person or entity.
  • Non-refundable. Drachmas cannot be redeemed for cash, gift cards, or any form of real-world payment.
  • Revocable. We reserve the right to adjust, reset, or remove drachma balances if we detect abuse or violation of these Terms.

8.2 Earning and Spending

  • Drachmas are earned by completing games, maintaining login streaks, and other educational activities.
  • Drachmas can be spent on avatar customizations, and may be used in guardian-approved reward proposals (where guardians set the rewards).
  • Reward proposals are between guardians and students. We are not a party to any agreements about real-world rewards that guardians may offer.

8.3 No Obligation

We may modify the virtual currency system, including earning rates, spending options, and balances, at any time and for any reason.


9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information. Our Privacy Policy is incorporated into these Terms by reference.

If you are the guardian of a student under 13, please review the Children's Privacy section (Section 8) of our Privacy Policy and our Parental Consent Form carefully.


10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED CONTENT.
  • WARRANTIES THAT THE PLATFORM WILL MEET YOUR SPECIFIC EDUCATIONAL NEEDS OR PRODUCE PARTICULAR LEARNING OUTCOMES.

We do not warrant that AI-generated educational content is free from errors. The Platform is a supplementary educational tool and should not be relied upon as a sole source of instruction.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of educational progress, or emotional distress, arising out of or related to your use of the Platform.

  • OUR TOTAL AGGREGATE LIABILITY for all claims related to the Platform shall not exceed one hundred US dollars ($100).

  • WE ARE NOT LIABLE for any action taken by a guardian based on information displayed on the Platform, including academic decisions, discipline, or reward fulfillment.

  • WE ARE NOT LIABLE for inaccuracies in AI-generated content, including incorrect answers in educational games or misleading tutoring guidance.

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.


12. Indemnification

You agree to indemnify, defend, and hold harmless Socrates Educational Platform, its operators, administrators, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms or any applicable law.
  • Your use or misuse of the Platform.
  • Content you upload to the Platform.
  • Your violation of any third party's rights, including intellectual property rights.

If you are under 18, your guardian agrees to this indemnification on your behalf.


13. Dispute Resolution

13.1 Informal Resolution First

Before filing any formal proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration will be conducted in English.
  • The arbitrator's decision will be final and binding.
  • Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AND WE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

13.4 Exceptions

The following disputes are excluded from arbitration:

  • Claims that may be brought in small claims court.
  • Claims related to intellectual property infringement.
  • Emergency injunctive relief to prevent imminent harm.

13.5 Opt-Out

You may opt out of the arbitration agreement by sending written notice to [email protected] within 30 days of creating your account. If you opt out, disputes will be resolved in the courts identified in Section 14.


14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States and the State of New York, without regard to conflict of law principles.

If you opt out of arbitration or if a dispute falls outside the scope of arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in the State of New York.


15. Termination

15.1 By You

  • Students: Ask your guardian to remove you from the family, or your guardian can delete your account.
  • Guardians: You may delete your account and your family at any time through your account settings. This will deactivate all student accounts in the family.
  • Account deletion requests can also be made by emailing [email protected].

15.2 By Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice, including for:

  • Violation of these Terms or the Acceptable Use Policy.
  • Conduct that we reasonably believe is harmful to other users, the Platform, or third parties.
  • Extended inactivity (12 months or more), after providing 30 days' email notice.
  • Legal requirements.

15.3 Effect of Termination

Upon termination:

  • Your access to the Platform will cease.
  • Your data will be retained and deleted in accordance with our Data Retention Policy.
  • Provisions of these Terms that by their nature should survive (including Sections 6, 10, 11, 12, 13, and 14) will survive termination.

16. Modifications to These Terms

We may modify these Terms at any time. When we make material changes:

  1. We will update the "Last Updated" date at the top.
  2. We will notify all users (or their guardians, for students under 18) by email at least 30 days before the changes take effect.
  3. We will post a prominent notice on the Platform.
  4. Continued use of the Platform after the effective date of modifications constitutes your acceptance of the modified Terms. If you do not agree to the modifications, you must stop using the Platform and delete your account.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if it cannot be modified, it will be severed from these Terms. The remaining provisions will continue in full force and effect.


18. Entire Agreement

These Terms, together with the Privacy Policy, Acceptable Use Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and Socrates Educational Platform regarding your use of the Platform. These Terms supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.


19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any term will only be effective if in writing and signed by the appropriate party.


20. Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms without restriction.
